Here is one of the things I found out about Bill after I started researching him because his image was what got my masterfile letter.

http://www.dslreports.com/forum/remark,25965429

interesting stuff.  I had respected him and felt bad about using his image (although it was in an altered state from its original form and came from another search that I thought was public domain...neither here nor there) until I found this post.  Then I started searching more about anything at all I could find about him, the gutless worm who sent the letter and the pussy masterfile owner.

also Bill Frymire's images were bulk registered in the US in a CD format.  This format has been called into question and will likely not hold up in court again.

Great response to the question.  That should go into a sticky or the FAQs.  I did the letter program and I STILL had the same questions just asked...up until now that is.   ;D

Short of paying them a visit in person as I wanted to do  ;) your best bet is to hire Oscar and pay the $250 to him for the letter program.  Best $250 you will spend for peace of mind and not having to deal with these guys directly.  They are scum and gutless and prey on people who are too afraid to stand up to them.

ahem...present company excluded Oscar.  ;)

b. in order to access a computer without authorization, the machine in question would need to be password protected.. I don't buy into or surmise that "any computer connected to the internet is protected"

I not so sure I agree with this statement.  I think joee may be on to something because if you jump on your neighbors wireless internet access you can be prosecuted.  The wireless is wide open with no encryption but you are in violation of using their internet.  You may also see any files and folders on their computer because they have no passwords on shared folders.

These bots are essentially working in the same manner by going beyond the folders used in the actual use of the web page and blog and are in fact scanning folders that are used for basic storage.  The file may not be put out for public viewing and there are no laws (as far as I am aware) that state you can not have a file on your computer (or cloud storage) for your own personal viewing.  Lets put into perspective that we could use the same argument that if they did not password protect their pictures in the first place then we have not committed any copyright infringement.  And back to the issue of cloud computing.  What is to say that these companies do not create a bot that can overide securities in place for cloud storage to scan files?  Since these files are on the "open Internet" per se then where do we draw the line?

Great advice Robert.  There seems to be a LOT of that on this site.  ;D

Thanks Robert.  The domain is listed in and part of my account with a registrar along with a few other domain names.  I think somewhere along the line we forgot to remove his name after he transferred it to my account.  I just don't want to cause any headaches for him when he wasn't even involved. And this was from Masterfile and not Getty so I am not sure if that even changes how to deal with it.

Not so sure.  I know the guy it is sent to and I am friendly with him.  The website was changed by me and I added the photo after I had found a cropped version of the original on a search.  The photo never showed any copyright and was modified from its original (I found the original after getting the letter) from where I had found it.  I do not want this guy dealing with any problems from a photo I put up.  He lives in another state and hasn't had anything to do with this business in many years. I think his name still shows up on the whois search so that is likely how Masterfile sent it to him at my address.

Thank you for your reply Greg.  The letter was actually sent to someone elses name at my address but it is for my website.  The name on it is from the guy who used to own the web address but it is now my site.  I have no idea what to do so after doing more reading here and watching the videos after my first post I will be contacting Oscar for the letter.

I have just received a letter from Masterfile for one image.  I recall getting the image from Google at one point but seeing no copyright information stated on it.  I do plan on joining the letter program Oscar offers but does this include dealing with Masterfile or just Getty?  They are demanding just shy of $2k for the one image and I can't afford to pay that.  I am trying to read up as much as I can on this forum and Internet but I just want to thank you all for helping us who are in panic mode after getting these letters.
