Getty Images Letter Forum / Linda Ellis back to Her Old Tricks Again?

Well it appears that Linda Ellis is back to her old tricks again. She just recently released another long video using the same old twisted and out of context facts to claim victim status of a cyber bully. I will not give her video any SEO juice by sharing a link to it here but our own April Brown did a good follow-up video which I have included with some commentary here.

Eli Community,

I am asking for you help, ELI's own Robert Krausankas (BuddhaPi) needs our help.  He has come under attack from an anonymous source (currently anonymous) and taking a page from Linda Ellis' play book has started sending emails to Robert's customers, sports leagues he and his wife are involved with and his wife's work place associates.  The legal issues are being handled but Robert will be sending responses to those that have received the anonymous (fake email accounts) emails and I would like for those here that know Robert to write a character testimonial letter on his behalf that he can include along with his response.  For those of you that have been around a while you will remember we all did the same thing for Matthew during his fight with Linda Ellis.

Getty Images Letter Forum / Should LCS Get IT's Own Forum?

Matthew,

With all the activity we are seeing from LCS do you think they should get their own heading like McCormack did to make it easier for the LCS letter recipients to find the LCS threads?  Just a thought.

I just realized that today is the end of my statute of limitations.  Although I felt fairly confident Getty was not going to come after me (and kind of sad they didn't try) it is still good to know that this part of my Getty experience is over. 

I am not going anywhere and will continue on here assisting new letter recipients explore their options and encouraging those who feel that they have been treated/handled unfairly to file Attorney General complaints, speak up and make their voices heard.

On the bright side of this, if I had not received that letter and Getty refused to negotiate in good faith I would have never become involved with ELI or have made so many life-long and valued friends.  So thank you Matthew, Robert, Oscar, April, Joe and the rest of the family, it is a privilege and pleasure to talk with you, work with you and most of all call you friend.

I have had an iStock contributor reach out to me and share something interesting.  Apparently right after the announcement that iStock parent company Getty Images burned through 1/3 of their cash reserves in the last quarter of 2014 iStock made several changes to what the contributors have to do to get paid.  The new forms/rules seem to be very confusing to many of iStock's contributors and they are now not receiving their payments.  There are also many complaints that there has not been a support phone number for a few years now and their support emails are not being answered in a timely manner or at all.

The contributor who contacted me directed me to the iStock contributor forum which is rife with complaints such as this...

….The whole thing has been an unreal hassle, from the tax interview not going through, to emails going to getty and taking weeks to be anwsered, often leaving me with both more hoops to jump through and more questions and more delays.  I finally said screw it, use the iStock paperwork and take out the tax, but didn't see that my account was on hold unitll  I filled out the new paperwork.  Funny how my paperwork was just fine for iStock and for every other stock photo agency and client I work with... but not for Getty.

COURT OF APPEALS ORDERS GEORGIA CENSORSHIP CASE
TRANSFERRED TO GEORGIA SUPREME COURT

In an unexpected twist in the ongoing Georgia website censorship case of Matthew Chan, anti-troll website owner of ExtortionLetterInfo.com ("ELI") and Linda Ellis, poet and author of "The Dash", the Georgia Court of Appeals ordered the case be transferred to the Georgia Supreme Court.

The order by the Court of Appeals stated that "the entire record and the briefs of the parties… raised significant and novel constitutional issues addressing… the First Amendment". Further, "the briefs make clear, the appeal raises issues of first impression in Georgia" and there was "very little if any applicable law in other jurisdictions."

In February 2013, Chan lost a case against Ellis where she charged him with allegedly stalking her, and posting her home address, family information, and death threats on ELI. However, many of those posts were made by third-party visitors to ELI, not Chan himself and neither Chan nor the website was ever requested to take down any of the allegedly offensive posts. Nevertheless, Ellis was awarded a sweeping Permanent Protective Order by the local court. That order, required among other things, a wholesale removal from ELI of  all 2,000 posts by anyone that ever mentioned Ellis, her poem, or her business practices in any way.

In August 2013, Chan appealed the lower court’s permanent protective order. Oscar Michelen and William J. McKenney, who are representing Chan on this appeal, filed a motion to have the case transferred to the Supreme Court on the grounds that Chan’s rights under the First Amendment were being "improperly restricted and violated." The Court of Appeals denied that motion on the basis that the appeal did not "challenge the constitutionality of a law, ordinance, or constitutional provision." It did not appear to the Court at that time "that subject-matter  jurisdiction" was "proper for the Supreme Court."

With the denial for his motion to transfer his case to the Supreme Court, Chan filed his briefs with the Court of Appeals as scheduled. A series of briefs submitted by both Chan and Ellis concluded in November 2013 and the parties were awaiting a decision from the Court.

Instead, the Court of Appeals has now agreed that jurisdiction properly lies with the Supreme Court and has transferred the appeal there. Oscar Michelen states, "I am glad the Court of Appeals recognizes that these issues are ones which need to be addressed by the State’s highest court as they touch upon issues of first impression and of Constitutional significance. I look forward to the Georgia Supreme Court’s determination of the merits of our appeal."

Chan’s reaction to the legal twist, "I am gratified that the Court of Appeals agreed with us that the issues raised in my appeal needed to be reviewed by the Georgia Supreme Court. The scope and potential impact of the outcome of this case goes far beyond me and the ELI website. It goes to all website owners and forum administrators in Georgia and possibly outside the state."

After this appeal was docketed, but before the parties filed their briefs,appellant Matthew Chan filed a motion to transfer the appeal to the Supreme Court of Georgia, asserting that the appeal raised constitutional issues under that court’s exclusive jurisdiction. This court denied that motion on the ground that the appeal did “not challenge the constitutionality of a law, ordinance, or constitutional provision." Accordingly, it does not appear at this juncture that subject-matter jurisdiction is proper in the Supreme Court.” (Emphasis supplied.)

The entire record and the briefs of the parties and of amicus curiae, however,have raised significant and novel constitutional issues addressing the interplay of the First Amendment and the wide dissemination of information made possible by the internet, particularly with respect to the issuance of a permanent protective order and the trial court’s broad discretion to bring about the cessation of conduct constituting stalking. As the briefs also make clear, the appeal raises issues of first impression in Georgia, and there is very little if any directly applicable law in other jurisdictions.Therefore, while the appeal does not “draw in question” the constitutionality of any statute within the meaning of Ga. Const. of 1983, Art VI, Sec. VI, Para. II (1), it is a case “involving the construction of . . . the Constitution of the State of Georgia or of the United States” within the meaning of that provision.

Accordingly, this appeal is hereby TRANSFERRED to the Supreme Court.

Getty Images and McCormack Law's practice of demanding payment while refusing to honor request for proof of claim has long been an issue with myself and the ELI community.  I found a complaint that may show Getty has crossed the line. 

A web developer offered Getty FULL payment to make the claim go away and leave his client alone.  Getty refused to accept full payment because the web developer ask Getty to provide proof that Getty had the legal right to collect on behalf of the artist.  Getty told the web developer who offered FULL payment he needs to talk to a copyright attorney and they were now going after the client.

This copy of the Getty Contributor Agreement was anonymously provided to us for use by a former Getty contributor.

After a quick read it looks to me as if the contributors are signing over control of their work for very little share of the profits.

I was checking for updates on a few cases I have been following in PACER and I noticed that the Ron Raffaelli (Rock Photo) case had been closed. 

If you do not remember/know of this case Mr. Raffaelli claimed that Getty Images knowingly and willfully purchased stolen images of his and then made them available for licensing.

The case was just settled on 03/04/2014 and just like the Aloha Plastic Surgery case we will never get to know what it was as both parties agreed to drop the case leaving the court with jurisdiction to enforce the settlement.  Getty as usual insisted on keeping the details private.

Getty has become a lawsuit magnet of late, they settled this case, they just lost the Daniel Morel case along with AFP to the tune of 1.2 Mil, they are being sued by sports photographers for thousands of images used without permission and they were just sued for patent infringement.  There are also at least two other cases ongoing right now as well.

I don't know how much more of this Getty can absorb before the whole company collapses in on itself.

I came across this ruling from the United States 9th District Court of the Western District of Washington and found it extremely interesting and a possible game changer. This is your typical greedy troll elf P2P case where Elf-Man, LLC filed “boilerplate” lawsuits against Does 1-152.

During a House Judiciary Subcommittee hearing on March 13, 2014 WordPress General Counsel Paul Sieminski spoke in-depth about the problems created from a flood of false DMCA takedown notices. The system is being used to curtail freedom of expression and significant resources are being used to deal with the false DMCA takedowns.

Getty Images Letter Forum / Getty Images Sued for Patent Infringement

I was cruising around in PACER this evening when I noticed this lawsuit filed against Getty Images on December 10, 2013 for patent infringement. I have not seen this covered anywhere else so my apologies if it is already been done but it seems that Uniloc USA, Inc. alleges Getty Images used their patented software which is “generally directed to an integrated rights management and licensing system for storing, researching, buying and selling intellectual property”
