Higbee Associates Letter & Lawsuits Forum / Higbee and Associates put out Fake News

On Higbee's website they claim they were named one of the top hundred most active copyright litigation law firms for 2016 here's the link  https://www.higbeeassociates.com/named-top-100-most-active-copyright-firms-2016/https://www.higbeeassociates.com/named-top-100-most-active-copyright-firms-2016/

However when I went to the   website  https://lexmachina.com/  I can't find such a list.  So I Googled:  Lex Machina most active copyright litigation 2016, nothing pops up except for Highbee's press release. 

I think this really is advertising to scare up business for his copyright extortion operation

This is exactly what Higbbe wants for people to fold under the preasure.  I'm in the same position but I look at it in terms of I'm one of hundreds.  I don;t want to be the low lying fruit.  So I'm hoding firm.  Is it a pain?  Yes!  But, I refuse to be taken advantage by somebody of low character.  That what Higbee a low character who say a busness medel he wanted to ge in one.  He's not even a intelectual prop lawyer.  His main businees is record expundgement.  Stay strong!

Glad to contribute to the community.  But, I got a question of my own.  I got a call on my cell from a case manager for Higbee and Assocs.  I don't know how they got my cell number.  Is this legal?  My phone was charging at the time and it went to voice mail which I deleted.  This is a new wrinkle.  I don't answer any calls that I don't know.  It's been my practice for a long time.   So npted the call and will keep a log of any future calls to go along with the file I'm keeping on Higbee of all communications.  Has anybody else received calls to your cell?

I just think Higbee is a shady slime bucket out for the quick buck.  His practice was originally in criminal record engagement and now he's doing this?  I look forward to you creating a dedicated thread on him and his dealings.

This video really helped me to know what a copyright infringement is all about.  A lot of demand letters is design to scare the ignorant.  But, it you learn what the deal is the less scared you'll be.

Higbee just sent me a collection message via email on Christmas day. Can you believe it? Classless intimidation.

Its probably an automated email.

I agree it's probably an auto mail.  But, that doesn't take away on how it reflects on the name behind it.  Not much of a law practice I think if it's reduced to sending demand emails on Christmas Day.  Keep everything he sends you in a file and get all your ducks in a row in order not to become low hanging fruit.

These theives run around on the internet posting fake positive reviews about their company. The truth is they need to post all these fake reviews because they are scamming inoccent people out of their hard earned money. Using Recordgone.com or one of his other shell companies Mathew Higbee and his "team" are charging thousands of dollars for work they never complete. They offer all kinds of fancy promises through their websies, but at the end of the day their service is complete junk and they will give you the run around over and over until they stick you with a multi thousand dollar bill. When you question the bill and services not delivered they will then threaten to sue you.

I can only speak for myself and the research I've done.  I don't like to get rolled and I don't respond will to intimidation.  This is their whole tactic to get your scared.  Like others have said don't panic, get educated the best you can.  As far as contacting the lawyer I'm of the opinion if you contact them then your telling them your spooked.  That's not a position of strength in my opinion.  I'm not going to talk to them and say something wrong they can use against me.  Others may disagree and I welcome their views.  As far as getting a lawyer to contact them, here's the problem with that.  That lawyer is gonna charge you money to deal with it.  It comes down to your stomach.  But, the more you educate yourself the more strength you gain.  Overall, it sucks.  But don't let it overtake your life.

Peeved Thanks.  I got a better understanding of fair use and it saddens me.  You really need to be a lawyer to get what the article is explaining.  A layman reads the law and in good faith thinks their doing thing not looking to hurt anybody or deprive anybody of anything.  Then an unscrupulous photog comes along and demands thousands  for a pic got $50 for.  No DMCA take down or acting like a gentlemen.  Just go straight to extortion.

Thanks Jerry for your response.  I've been reading the forum and reading other sources about fair use and I understand a little better about the gray area.  I guess it depends on the judge. Clearly, the copyright law doesn't address internet age.  If a Blogger wanted to cover a crime that happened the day before and wanted to track down photographer to purchase a license, by the time this is accomplished, it's a day or two later and the crime event is no longer "news"  it's become old news.  And the blogger is not injuring the photog because he's made his money selling or licensing his photo to the tabloid.  And the value of that photo goes down as the days pass, especially if the perpetrator of the crime is Joe Sshmo, not a public figure or a celebrity, but a nobody who committed a crime.  This is a good discussion.

Thanks DavidVGoliath for your response.  I'm disappointed to hear that fair use is such a gray area.  The "news reporting" is term is written in the copyright law and that is what the blogger is doing in my scenario.  Also I feel a crime photo is not a creative work such as a book or a photo of sunset whereby some photographic skill is needed to enhance the pic.  A crime pic is an actual event.  Not to say it doesn't have copyright protection I does.  But it should be less protection than a work of fiction.  Worst case?  The Blogger is liable for the value of the lic the photog got for the license he got from the tabloid.  Is that far fetch?

Thanks Robert!  I know hypothetical didn't give much detail.  I just did some research on first sale rights but I'm still unclear as to the ramifications of it and photogs/Copyright trolls trying to get over on people for pics they've already sold.
